These terms govern your use of QEEK. By using our service, you agree to be bound by these terms.
Acceptance of Terms
By accessing and using QEEK's AI-powered codebase understanding platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") apply to all users of the Service.
You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.
Description of Service
QEEK provides an AI-powered codebase understanding platform that:
- Analyzes your codebase using AST-level analysis to understand patterns, architecture, and dependencies
- Generates AI Tickets with implementation-ready specifications and step-by-step guidance
- Generates Code Wiki documentation (Tech Stack, Directory Structure, Project Overview, API docs)
- Enables semantic search across your codebase using embeddings
- Facilitates seamless handoff from product ideas to implementation-ready tickets
Important: AI-generated content, including tickets and documentation, is provided for informational purposes. You are responsible for reviewing, validating, and testing all AI-generated content before use. QEEK does not guarantee the accuracy, completeness, or suitability of AI-generated content.
User Accounts
To access certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized use
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any laws
- Upload malicious code or attempt to compromise our systems
- Reverse engineer or attempt to extract the source code of our Service
- Use the Service to process data you do not have the right to process
- Share your account credentials with unauthorized parties
- Attempt to circumvent usage limits or restrictions
- Use automated systems (bots, scrapers) to access the Service without permission
- Export or re-export the Service in violation of applicable export control laws
Intellectual Property
Your Content
You retain ownership of your code, data, and content. You grant us a limited license to process this content solely to provide our Service to you, including creating embeddings and performing code analysis.
Our Service
The QEEK platform, including its software, algorithms, AI models, and documentation, is protected by intellectual property laws and remains our exclusive property.
Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you. You grant us a perpetual, irrevocable license to use, modify, and incorporate such feedback into our Service.
Alpha/Beta Testing
QEEK is currently in Alpha development with limited Beta testing. During this phase:
- The Service may contain bugs, errors, or incomplete features
- We may modify or discontinue features without notice
- Data backup and recovery capabilities may be limited
- Service availability is not guaranteed
- Beta access is by invitation only and may be revoked
Data Processing and Privacy
Our processing of your data is governed by our Privacy Policy. Key points:
- We do not store your actual source code files from GitHub
- We process code from GitHub to create embeddings and perform AST-level analysis, storing only truncated code previews
- When generating AI Tickets or using AI chat, we access code directly from GitHub in real-time
- Code embeddings and analysis are stored securely and associated with your account and repositories
- We use industry-standard security measures including encryption in transit and at rest
- You can export or delete your data at any time, including codebase embeddings
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may suspend or terminate the Service for maintenance, security, or other operational reasons.
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or failures of third-party services.
Warranties and Disclaimers
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND:
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
- We do not warrant that the Service will be uninterrupted, error-free, or secure
- AI-generated content may contain errors, inaccuracies, or may not be suitable for your specific use case
- You are solely responsible for validating and testing all AI-generated content before use
- We do not guarantee the accuracy, completeness, or reliability of any information provided by the Service
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- QEEK's total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater
- QEEK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption
- QEEK shall not be liable for any damages resulting from your use of AI-generated content
- These limitations apply even if QEEK has been advised of the possibility of such damages
- Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you
Termination
Either party may terminate these Terms at any time. Upon termination, your right to access the Service will cease immediately.
We will provide at least 30 days' notice before terminating your account (except for violations of these Terms). You will have the opportunity to export your data during this period. After termination, we may delete your data in accordance with our data retention policies.
We may immediately suspend or terminate your access for violations of these Terms, illegal activity, or to protect the security of the Service.
Changes to Terms
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in Hong Kong in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC), except where prohibited by law. You waive your right to a jury trial and to participate in class actions.
Note: These Terms reference Hong Kong as the intended jurisdiction of incorporation. If the company is incorporated in a different jurisdiction, these Terms will be updated accordingly.
